ANJANA MISHRA ORAL ORDER 05-12-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Kinjar P.S. Case No.17 of 2019 (Excise Case No.184/2019) registered for the offence punishable under Section 30(A) of the Excise Act, 2016.

Learned counsel for the petitioners submits that the alleged recoveries from the motorcycle were not to the knowledge of the petitioners and the said seizure has not been made in their presence and thus nothing has been recovered from their conscious possession.
