The petitioner is languishing in custody for the offences punishable under Sections 304B/201/120B/34 of the Indian Penal Code.
Petitioner is husband of the victim of dowry death. Marriage was solemnized eight years back. The victim was mother of two children. During investigation some witnesses stated that in the past also the victim had attempted to commit suicide. She was not mentally well.
Considering the facts and circumstances of the case especially the fact that presumption of dowry death is not against the petitioner and petitioner is in custody since
Patna High Court CR. MISC. No. 4193 of 2019(5) dt.18-04-2019 2/2 17.07.2018 as well as investigation of the case is already complete, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Andharatharhi P.S. Case No.74 of 2018, with condition that petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
