JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-12-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Hussainganj P.S. Case No. 269 of 2018 for the offence under Sections 30(a) and 36 of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He submits that the name of the petitioner has been surfaced on the basis of confessional statement of co-accused Sunita Devi and Usha Devi. He submits that nothing has been recovered from the possession of the petitioner and he has no concern with the trade of liquor or the liquor seized in the instant case. Considering the aforesaid, the petitioner named above, in the event of arrest or surrender before the court below
Patna High Court Cr.Misc. No.76712 of 2018(2) dt.19-12-2018 2/2 within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum-Special Judge, Excise Act, Siwan in connection with Hussainganj P.S. Case No. 269 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
