JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2020 This modification application has been filed for modification of order dated 09.05.2019 passed in Cr. Misc. No. 10478 of 2019, by which, the petitioner no. 1 was directed to surrender in the court below within a period of six weeks for grant of regular bail.

Submission of learned counsel for the petitioner is that due to some inadvertence, he could not surrender in the court below within the time fixed by this Court and thus prayed for modification of order dated 09.05.2019.

Having heard both sides, considering the fact and circumstances and also the fact that once the prayer for grant of

Patna High Court CR. MISC. No.81705 of 2019(2) dt.22-01-2020 2/2 anticipatory bail is rejected, it is always open to petitioner no. 1 to surrender in the court below for grant of regular bail, as such, I do not find any reason to modify the order dated 09.05.2019 passed in Cr. Misc. No. 10478 of 2019.

Accordingly, this modification application disposed of.
