The petitioner, who has clean antecedent and is in custody since 31.08.2019, seeks bail in connection with Bhagwan Bazar P. S. Case No. 416 2019 dated 30.08.2019 instituted for the offences under Sections 30(A) and 37(C) of the Bihar Prohibition and Excise Act, It is alleged that 50 litres of liquor was recovered from a bush, from where the petitioner and others wanted to flee away but was arrested. The

Patna High Court CR. MISC. No.80636 of 2019(2) dt.16-12-2019 2/2 petitioner was also found to be inebriated.

Considering the period of custody of the petitioner and his clean antecedent, this petition is allowed.

The petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge cum Special Judge, Excise, Saran in connection with Bhagwan Bazar P. S. Case No. 416 2019.
