JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2018 The petitioner seeks regular bail in connection with Barachatti (Mohanpur) P.S. Case No. 676 of 2018, registered for offences punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 40 liters country made liquor from the possession of the petitioner. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case. As a matter of fact nothing has been recovered from his possession and while he was going through the place of occurrence, he was arrested and made accused in this case and is in judicial custody since 13.10.2018.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts,

Patna High Court Cr.Misc. No.74887 of 2018(2) dt.21-12-2018 2/2 let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Gaya, in connection with Barachatti (Mohanpur) P.S. Case No. 676 of 2018.
