JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-02-2020 This application has been filed for cancellation of the bail granted to the O.P.no.2 vide order dated 7.3.2019 in Bail Petition No.235 of 2019 arising out of Mahua P.S.Case no.374 of 2018 420, 467, 471, 472 and 120(B)/34 Sections of the IPC. Grounds for cancellation of the bail is of nonappreciation of the fact by the learned Addl. Session s Judge that the land was never mutated in the name of the accused persons and considering only some documents, he has granted bail to the petitioner, which does not appear to be proper.. Patna High Court CR. MISC. No.86250 of 2019(2) dt.17-02-2020 2/2 moved before the Deputy Director, Consolidation and the same was decided in favour of the accused persons and the money suit is pending between the parties and also considering the fact that the case is civil in nature, he has been granted bail. There is no allegation of misuse of the privilege of the bail or tampering with the evidence.
In view of the discussions made above, there is no merit in this application.
According, this application is dismissed.
