In this case, the petitioner is seeking anticipatory bail in connection with Ram Krishna Nagar P.S. Case No.596 of 2019 registered for offence punishable under sections 419 and 420 of the Indian Penal Code.

In SSC- MTS examination, one Sauraf Kumar, who is the friend of the petitioner, was arrested and found that he has impersonated the present petitioner.

The learned counsel for the petitioner submits that as per provision of law, it has to be investigated by the Deputy Superintendent of Police and the summary trial has to be conducted by the Executive Magistrate.

Be that as it may, the case at hand is confined to grant

Patna High Court CR. MISC. No.79097 of 2019(2) dt.11-12-2019 2/2 bail, this Court has to consider as to whether it is fit case for grant of anticipatory bail, not required to look the trial or investigation.

In such view of the matter, this Court is not inclined to grant bail to the petitioner and, accordingly, his prayer for bail is rejected. However, if the petitioner surrenders before the court below and prays for regular bail, on the same day the court below will look into the matter and pass an order in accordance with law.
