The matter has been listed under the heading 'For Orders' under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner is apprehending his arrest in a case registered under Section 147, 148, 149, 341, 323, 324, 307, 354(A), 379, 447, 504 of the Indian Penal Code and 27 of the Arms Act.
Allegation is that accused Shobhi Yadav fired on the informant, as a result of which he sustained fire arm injury and the petitioner also fired on the informant but his wife Parmila
Patna High Court CR. MISC. No.79901 of 2019(4) dt.08-09-2020 2/3 Devi sustained injury in her back.
It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. As per the allegation, the petitioner is said to have caused injury upon the victim Parmila Devi. From perusal of the case diary and the report submitted by the Superintendent of Police, it appears that there is no injury report of the victim Parmila Devi. The informant only with a false allegation has tried to implicate the petitioner in the present case. On behalf of the State and learned counsel for the informant, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of eight weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. III, Jhanjharpur, District Madhubani in connection with Bheja P.S. case No.103 of 2018 corresponding to G.R. No.1366 of 2018, subject to the conditions as laid down under Section 438(2) of
Patna High Court CR. MISC. No.79901 of 2019(4) dt.08-09-2020 3/3 the Code of Criminal Procedure.
