Petitioner is claiming compassionate appointment being son of the deceased employee who died in harness in the services of respondent- Bihar Renewable Energy Development Agency on 07.08.2017.

Petitioner's claim (Annexure 5) before the Director of the said agency is pending consideration.

Since issue has to be decided by respondents themselves, pendency of instant proceedings would serve no useful purpose.

Counsel for the petitioner however, submits that he would be filing copies of and relying upon judgments of this court in CWJC no. 1176/2007 as also CWJC no. 392/2017 in

Patna High Court CWJC No.405 of 2019(2) dt.11-07-2019 2/2 support of his claim for consideration before respondent no.3. Petitioner would be at liberty to file the same before respondent no.3 within two weeks.

This court would direct irrespective of the fact whether said judgments are filed or not within the said time, respondent no.3 should take a final decision on the claim of the petitioner by reasoned and speaking order in accordance with law, maintaining parity with others, if benefit has been granted to others in the Agency (BREDA).

Let claim be decided expeditiously without undue delay and preferably within eight weeks thereafter. Writ petition stands disposed of.
