This application for anticipatory bail arises out of N.D.P.S. Case No. 06 of 2019, Brahmpur (Chakki) P.S. Case No. 73 of 2019, disclosing the offence under Sections 15(c), 18(B)(C) of the N.D.P.S. Act, 1985.

Allegedly, 22 persons named in the FIR were cultivating opium over a piece of land belonging to coaccused Parsuram Yadav. Co-accused Dashrath Yadav was arrested by the police, who appears to have admitted his involvement and others in cultivation of opium. Learned counsel appearing on behalf of the

No.83225 of 2019(4) dt.26-06-2020 2/3 petitioners has submitted that in similar circumstance, coaccused Ramavtar Yadav, Yogi Yadav, Laxuman Yadav have been granted anticipatory bail by this Court by order dated 24.10.2019, passed in Cr. Misc. No. 49260 of 2019. Further, one Appu Turha has been allowed anticipatory bail by this Court by an order dated 14.11.2019, passed in Cr. Misc. No. 69997 of 2019.

Considering the fact that similarly circumstanced co-accused have been allowed anticipatory bail, this application is allowed. Let the petitioners, abovenamed, in the event of their arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each, to the satisfaction of the learned District and Sessions Judge-cum-Special Judge, NDPS Act, Buxar in N.D.P.S. Case No. 06 of 2019, Brahmpur (Chakki) P.S. Case No. 73 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/ Court, as the case may be, as and when required and in the event of failure on
