The petitioner, who is in custody since 01.08.2019, seeks bail in connection with Sessions Trial No. 241 of 2019, arising out of Madhepura P. S. Case No. 585 of 2019 dated 02.07.2019 which was initially instituted under Sections 341, 323, 385, 307, 324, 448, 379 and 34 of the Indian Penal Code but later, with the death of one Bimla Devi, Section 302 of the Indian Penal Code was added.

It has been alleged in the F.I.R. that two of the sons of the petitioner and others demanded protection

One of the sons of the petitioner is alleged to have assaulted the deceased by means of a sharp cutting iron weapon which ultimately led to her death. Another son of the petitioner is alleged to have opened fire in order to scare away the crowd.

From the perusal of the F.I.R., it appears that no specific accusation has been levelled against the petitioner.

It has further been submitted that because of the petitioner being the father of the assailant of the deceased, he too has been made accused in this case. Some of the other accused persons of this case having similar allegation against them have been granted bail by different Benches of this Court.

Considering the afore-mentioned facts, the petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like
