2. The petitioner has preferred this application for grant of regular bail in connection with S.Tr. No. 388 of 2021 arising out of Giriyak (Katrisarai) P.S Case No. 388/2020 dated 17.10.2020 registered for the offence punishable u/s 302 read with 34 of the Indian Penal Code.
3. As per the prosecution case, the petitioner and other co-accused person in connivance with one another are alleged to have beaten the informant's daughter to death on account of giving birth to three female children.
4. Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.11815 of 2024(3) dt.03-05-2024 2/3 that the petitioner is innocent and has falsely been implicated in this case. The petitioner has clean antecedent as stated in para 3 of the bail petition. There is general and omnibus allegation against the petitioner who is husband of the deceased. The other co-accused persons have already been granted bail by this Court vide order dated 27.07.2022 passed in Cr. Misc. No. 8495/2022. The petitioner is in custody since 27.02.2021.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Nalanda in connection with S.Tr. No. 388 of 2021 arising out of Giriyak (Katrisarai) P.S Case No. 388/2020, with the condition:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every
Patna High Court CR. MISC. No.11815 of 2024(3) dt.03-05-2024 3/3 date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
