JUSTICE SHAILENDRA SINGH ORAL ORDER (Per: HONOURABLE MR. JUSTICE RAJAN GUPTA) 12-07-2022 Writ Petitioner had approached this Court for issuance of direction to the respondents to make payment of retrial dues, i.e., Gratuity, Leave Encashment, Provident Fund, etc. with statutory and penal interest within stipulated time. Writ Petition was disposed of on 29th October, 2018. The operative paragraphs thereof read as under:

Accordingly, the writ petition stands disposed off with liberty to the petitioner to approach the authorities concerned with regard to the dues payable to her, vis-à-vis, the dues claimed by the Corporation to be payable by her late husband.

6. If the petitioner files detailed representation before the Managing Director of the Corporation within three weeks from today, the same shall be considered and disposed off by passing a reasoned order within one month from the date of filing of the representation, in accordance with law."

On a query being put to learned counsel for the appellant whether he made any representation to the Managing Director, State Food and Civil Supplies Corporation Limited, Bihar, no clear answer is forthcoming. However, he submits that he is ready to file a representation within two weeks from today.

Learned counsel appearing for the Corporation assures the Court that in case such representation is filed, same shall be dealt with forthwith and order passed by the learned single Judge will be complied. He further assures that a speaking order shall be passed which shall be conveyed to the appellant officially.

It is made clear that in case there is any dereliction

Patna High Court L.P.A No.1679 of 2018(6) dt.12-07-2022 3/3 or disobedience of this order, the Chief Secretary, State of Bihar shall be at liberty to take appropriate disciplinary action against the respondent no. 3.

Appeal stands disposed of.
