The petitioner is languishing in custody since 04.06.2018, though, learned counsel for the petitioner submits that in the impugned order same has wrongly been recorded as 04.08.2018, in a case registered for the offences punishable under Sections 25(1-B)a and 26 of the Arms Act.

The prosecution case, as per the self statement of Sanjeet Singh, S.H.O., Suryapura Police Station dated 03.06.2018, is to the effect that the informant along with other police personnel went to arrest the petitioner in connection with Suryapura P.S. Case No. 64 of 2018 at his in-laws place, where he was arrested and from his possession, county made pistol and seven cartridges were recovered.

Patna High Court Cr.Misc. No.5524 of 2019(2) dt.01-02-2019 2/2 It is submitted by learned counsel for the petitioner that the petitioner has been framed in the present case and no recovery has been made from the petitioner. It is further submitted that investigation has already been concluded.

Learned APP submits that recovery has been made from the petitioner.

Considering the fact that investigation has already been concluded and period under custody, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned ACJM, Bikramganj, Rohtas at Sasaram in connection with Surajpura P.S.
