JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-01-2020 The petitioner seeks regular bail in connection with Special Case No. 9467 of 2019 arising out of Bakhtiyarpur P.S. Case No. 334/2019, registered for offences punishable under Sections 484, 420 and 34 of the Indian Penal Code and later on added Section 30 (a) of Bihar Prohibition & Excise Act. Allegation is of recovery 163 litres of liquor from XUV Car and petitioner was arrested on spot.

It has been submitted on behalf of the petitioner that he has no criminal antecedent an has falsely been made accused in this case and the car does not belong to the petitioner and he was only a passenger in the car and he has been in custody since 24.10.2019 and chargesheet has been submitted and there is no chance of tampering with the evidence.

Having heard both sides, in view of the submissions

Patna High Court CR. MISC. No.80500 of 2019(2) dt.13-01-2020 2/2 as above, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Special Case No. 9467 of 2019 arising out of Bakhtiyarpur P.S. Case No. 334/2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
