2. The petitioner apprehends his arrest in connection with Chautham P.S. Case No. 199 of 2025 dated 15.07.2025, registered for the offences punishable under Sections 126(2), 115(2), 117(2), 109 and 352 read with Section 3(5) of the B.N.S., 2023.

On account of a dispute arisen due to fixing of the roof, the accused persons including the petitioners who were variously armed with iron-rod and other weapons came there and brutally assaulted the informant and others. It is specifically alleged that one co-accused Nitish Kumar assaulted over the head of the informant's son by means of iron-rod, whereas coaccused Priti Singh assaulted another son of the informant.

4. Learned Advocate appearing on behalf of the

No.85295 of 2025(2) dt.24-12-2025 2/3 petitioner taking this Court through the FIR contended that save and except the petitioner is said to be a member of the mob, there is no allegation of any overt act leading to any injury. Moreover, co-accused Nitish Kumar and Priti Singh are not before this Court against whom there are specific accusation. In fact, on account of a land dispute the parties have entered into a free-fight resulting into injuries to the persons of both the sides and institution of case and counter case bearing Chautham P.S. Case No. 198 of 2025, which is certainly on earlier point of time. The prayer for bail of the petitioner is negated only on account of the reason of having a criminal antecedent as has been disclosed in paragraph no. 3 of the bail application. The petitioner undertakes that he will fully cooperate in the proceeding of the Court.

5. On the other hand, learned Advocate for the State vehemently opposed the pre-arrest bail application and submits that the petitioner has actively participated in the crime.

Regard being had to the submissions advanced by the learned Advocates for the respective parties and taking note of the nature of accusation, coupled with the counter case which is on earlier point of time besides the undertaking of the petitioner, let the petitioner, above-named, be released on bail,

No.85295 of 2025(2) dt.24-12-2025 3/3 in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt / production of a copy of this order, upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Chautham P.S. Case No. 199 of 2025, subject to the conditions laid down in Section 482(2) of the B.N.S.S., 2023, with the further condition that one of the bailors shall be the own / close family members of the petitioner.
