2. The petitioner is seeking regular bail in connection with Vishnupad P.S. Case No. 146 of 2024 for the offences punishable under Sections 341, 307/34 of the Indian Penal Code and Section 25(1-b)a, Sections 26, 27 and 35 of the Arms Act.
3. As per prosecution case, the informant got secret information that some miscreants are assembled with arms for committing occurrence, upon such information, the informant along with other police personnel went at that place and after seeing the police team the miscreants started firing upon the police party due to which a person sustained injury. Accordingly, the FIR.
4. The learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.88416 of 2024(2) dt.20-02-2025 2/3 that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that the petitioner is not named in the FIR and the name of the petitioner came into light on the basis of disclosure made by local villagers. No incriminating article has been recovered from conscious possession of the petitioner. He has also submitted that on similar footing, co-accused Md. Babu @ Magaj @ Md. Saddam and co-accused Sudhir Kumar Sharma have been granted bail by this Court. The petitioner is under custody since 17.05.2024.
5. On the other hand, the learned APP for the State has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class at Gaya in connection with Vishnupad P.S. Case No. 146 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
7. Before accepting the bail bond, the learned court below shall verify the criminal antecedent of the petitioner
Patna High Court CR. MISC. No.88416 of 2024(2) dt.20-02-2025 3/3 and if it is found that he is involved in any case other than the case as mentioned in para-3 of the bail petition, his bail bond shall not be accepted.
