2. The petitioner seeks bail in connection with Barun P.S. Case No. 396 of 2024 instituted for the offences under Sections 318(4), 316(2) of the BNS.

3. Prosecution case, in short, is that petitioner has duped the informant of Rs. 80,000/- in the name of adding her name in the Sahayta Samuh.

4. Learned counsel for the petitioner submitted that the petitioner is innocent and has falsely been implicated in the present case. Learned counsel further submitted that there is no material on record to support the allegation that this petitioner has taken a sum of Rs. 80,000/- from the informant. It has been

Patna High Court CR. MISC. No.87561 of 2024(4) dt.20-03-2025 2/3 submitted on behalf of the petitioner that the petitioner is in custody since 16.10.2024 and has two criminal antecedents. However, after arguing at length, learned counsel for the petitioner submits that petitioner is ready to return 50 percent of the total disputed amount (Rs. 80,000/-), i.e. Rs. 40,000/- to the informant, if he is released on bail.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail.

6. Considering the aforesaid facts and circumstances of the case and since the petitioner is ready to return Rs. 40,000/- to the informant as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Barun P.S. Case No. 396 of 2024, subject to the following condition: (I) The petitioner shall return the amount, i.e. Rs. 40,000/- within four months after his release, out of which, he shall deposit Rs. 10,000/- in the account of the informant at the time of furnishing bail bonds; and the remaining amount, i.e. Rs.

Patna High Court CR. MISC. No.87561 of 2024(4) dt.20-03-2025 3/3 30,000/-, shall be returned by the petitioner in three equal installments in the account of the informant on or before 15th of every month.

8. It goes without saying that the aforesaid amount which the petitioner promised to return to the informant shall be subject to the final outcome of the case.
