====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-12-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 103(1), 61(2), 238 and 3(5) of the B.N.S., 2023.

3. As per the prosecution case, the informant alleged that the petitioner and his sister-in-law killed his brother because there was some monetary dispute between Md. Madrul and the deceased and there was also a love affair between the petitioner and co-accused Rabina Khatoon (wife of the deceased).

4. Learned counsel for the petitioner submits that the petitioner has been made accused only on the basis of suspicion. There is no eye-witness to the alleged occurrence. During investigation, no material has come to suggest the participation of

Patna High Court CR. MISC. No.84057 of 2025(2) dt.04-12-2025 2/2 the petitioner in this occurrence. The petitioner is in custody since 12.08.2025 and the charge-sheet has been submitted in this case.

5. Learned A.P.P. for the State vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the nature of accusation and the period of custody, the prayer for grant of bail to the petitioner is allowed.

7. Accordingly, let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea, in connection with Mirganj P.S.
