====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-03-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Mali P.S. Case No.63 of 2018 registered under Sections 341, 323, 307, 504 and 506 of the Indian Penal Code. The accusation is that in the evening of 19.10.2018, the petitioner went at the house of the informant Sahdeo Chauhan, and asked his wife Chinta Devi, to give the due amount on which Chinta Devi told that, at present, she has no money and she will give the money after arranging the same. Due to that reason, the petitioner started to abuse. When the informant made protest, then petitioner became annoyed and caused injury at the head of the informant through piece of

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that there is allegation against the petitioner to cause injury at the head of the informant through piece of bamboo but the injury of the informant is simple in nature. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Mali P.S. Case No.63 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
