JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-03-2020 The petitioner, who is in custody since 31.08.2019, seeks bail in connection with Pranpur P.S. Case No. 175 of 2019 dated 23.08.2019 instituted for the offence under Section 395 of the Indian Penal Code. The petitioner has not been named in the FIR and is sought to be prosecuted in the present case only on the basis of confession of a co-accused person. Though, it has come in the investigation reports that certain articles of common use including wearing apparels were found from the possession of the petitioner but the petitioner denies that those recovered articles are stolen property. Considering the aforestated facts, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Katihar in connection with Pranpur P.S. Case No. 175 of 2019.
