The petitioner has prayed for bail in connection with Special Case No. 9071 of 2019 arising out of P.R. No. 217 of 2019 registered for the offence punishable under sections 30(a) and 30(d) of the Bihar Prohibition and Excise Act, 2016. As per allegation in the prosecution report, 5-7 accused persons including the petitioner herein attempted to escape but the petitioner was caught and 10 litres of country liquor and 700 litres of soaked mahua flower is said to have been recovered.
It is submitted by learned counsel for the petitioner
Patna High Court CR. MISC. No.79563 of 2019(2) dt.04-12-2019 2/2 that petitioner is in custody since 13.10.2019 and has no criminal antecedent. Being a resident of the local area, he has been falsely implicated in this case under the wrong impression. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Patna in connection with Special Case No. 9071 of 2019 arising out of P.R. No. 217 of 2019.
