2. The learned counsel for the petitioners at the outset seek permission to withdraw the anticipatory bail application with respect to petitioner no.1 and 3.

3. Permission is accorded.

4. Accordingly, the anticipatory bail application is dismissed as withdrawn as against petitioner no.1 & 3.

5. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 191(2), 126, 115, 118, 117(2), 109 of B.N.S. 2023 in connection with Parsauni P.S. Case No.105 of 2024.

6. The learned counsel for the petitioners next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that specific allegation of assaulting the informant is against Amit and Rohit by the 'Dabiya' causing injury on head and as far as accused Awadhesh Rai is concerned the allegation against him is general and omnibus in nature.

7. The learned APP opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioners, the petitioner no.2 above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on anticipatory bail on his furnishing bail-bonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ist Class, Sitamarhi in connection with Parsauni P.S. Case No.105 of 2024, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

9. The application stands allowed.
