Petitioner apprehends his arrest in connection with Mohania P.S. Case No.765 of 2023 dated 29.10.2023, registered for the offence punishable u/s 30(A) of the Bihar Prohibition and Excise (Amendment) Act, pending in the Court of learned Special Judge, Ex. No.1 cum ADJ IV, Kaimur at Bhabhua. 3.

After some arguments, learned counsel for the petitioner seeks permission to withdraw this application. 4.

Permission is granted.

Accordingly, the instant application is dismissed as withdrawn.

However, petitioner is at liberty to surrender before the

Patna High Court CR. MISC. No.3441 of 2024(2) dt.01-02-2024 2/2 learned Court below within six weeks from today and seek regular bail and the learned Court below would pass the order, preferably, on the same day, in accordance with law, without being prejudiced of the withdrawal of this application.
