JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-01-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)a, 25(1-aa),26,35 of the Arms Act.

The mini gun factory is said to have been unearthed from the house of the petitioner and one country made pistol and cartridge are said to have been recovered from conscious possession of the petitioner whereas remaining apparatus were recovered from the house .

Earlier, the bail prayer of the petitioner was rejected by a co-ordinate Bench of this Court vide order dated 10.04.2018 passed in Cr. Misc. No. 20870 of 2018. Moreover,

Patna High Court Cr.Misc. No.239 of 2019(2) dt.17-01-2019 2/2 petitioner is in jail custody since 8.10.2017 and he does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge 1st, Nalanda at Biharsharif in connection with Session trial no. 12 of 2018 arising out of Karai Parshurai P.S.Case No. 95 of 2017.
