1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 342, 147, 148, 149, 447, 448, 452, 323, 324, 325, 307, 379, 427 and 302 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and he came to be implicated in the present case during the course of investigation. It is next submitted that no doubt the FIR was instituted under Section 302 of the IPC read with other sections but then the specific allegation of assaulting the deceased was against Nago Mandal and Srikant Mandal. It is also submitted that petitioner was not named in the FIR and his name transpired in the supervision report. It is further submitted that Kamlesh Mandal had approached this Court by filing Criminal Miscellaneous No.
Patna High Court CR. MISC. No.3805 of 2024(2) dt.13-02-2024 2/2 37902 of 2023 seeking anticipatory bail and the same was allowed by an order dated 01.08.2023. It is next submitted that the case of the petitioner is on a much better footing than that of Kamlesh Mandal as Kamlesh Mandal was named in the FIR when petitioner is not named in the FIR.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
5. Considering the submissions made by the learned counsel for the petitioner and also the fact that petitioner is a person with clean antecedent, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Chanan P.S. Case No. 180 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
