ABHISHEK REDDY ORAL ORDER 29-07-2025 The present writ petition has been filed for the following relief(s):- "A. For issuance of a writ in the nature of mandamus directing the respondent to rectify the ambiguity/difference in E-Pause Machine entered with respect to supply of good grains with differs from the actual supply made to the petitioner who is dealer under the Public Distribution System of Jinedpur Panchayat within the district of Begusarai.

B. For direction to the respondents to allow the petitioner to hand over the food grains to the another dealer as per the actual supply made to him after proper measurement as he is on medical leave as per the order of the Licensing

C. For direction to the respondent authorities to consider the grievance made by the petitioner by filing several representation without further delay in view of the letter no.3339 dated 15.7.2024 issued by the Secretary Respondent No.1 directing the Licensing Authority to remove ambiguity in the EPause Machine immediately in the State of Bihar.

D. To grant any other relief/reliefs for which the petitioner is legally entitled in the facts and circumstances of the case"

Learned counsel appearing on behalf of the petitioner states that there is discrepancy in the E-POS Machine given to the petitioner and therefore, the petitioner has given a suitable representation dated 30.09.2024 (Annexure-P/6) to the respondent No. 4 herein (i.e., Sub-Divisional Officer, Begusarai) but till date no orders are passed or any action has been taken for rectifying the E-POS Machine. Learned counsel states that a direction may be given to the respondent No. 4 to consider the said representation made by the petitioner.

3. Learned counsel appearing on behalf of the respondent-State states that he has no objection if a direction is given to the respondent No. 4 herein to consider the representation made by the petitioner in accordance with law.

4. Having regard to the above made submissions, the writ petition is disposed of directing the respondent No. 4 to

Patna High Court CWJC No.1132 of 2025(5) dt.29-07-2025 3/3 consider the representation made by the petitioner as expeditiously as possible preferably within a period of eight weeks from the date of receipt of a copy of this order. It is needless to mention that before passing any orders, the petitioner shall be given an opportunity of hearing. Any orders passed shall be communicated to the petitioner.

5. With the above direction, the present writ petition stands disposed of.
