Mr. Madan Mohan ====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 28-10-2021 Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Complaint Case No. 2449 of 2015 registered under Sections 406, 420 and 120B of the I.P.C. pending in the Court of Judicial Magistrate, 1st Class, Bhagalpur.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case. There is general and omnibus allegation against him.

Patna High Court CR. MISC. No.2114 of 2019(14) dt.28-10-2021 2/2 Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that there is specific allegation of taking money by committing fraud against the petitioner. Further he contended that petitioner has criminal antecedent. Hence, the petitioner does not deserve to be enlarged on anticipatory bail.

Having considered the facts and circumstances of the case and nature of the allegation, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer of the petitioner is rejected.
