The petitioners seek bail in connection with Darpa P.S. Case No.104 of 2019 registered under Sections 272 and 273 of the Indian Penal Code besides Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The accusation is of recovery of four polythene packets, containing 24 liters country made liquor, from the motorcycle on which both the petitioners were found sitting. Learned counsel appearing on behalf of the petitioners submits that the petitioners have no criminal antecedents and are in custody since 21.10.2019.

No.80208 of 2019(2) dt.06-12-2019 2/2 Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, East Champaran at Motihari, in connection with Darpa P.S. Case No.104 of 2019.
