In this case, the petitioners are seeking bail in connection with Kotwa P.S. Case No. 313 of 2019 registered for offence punishable under sections 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It has been alleged that 70 liters of raw liquor has been recovered from the possession of two persons. The petitioners are in custody since 06.11.2019, having clean antecedent.

Looking to the facts and circumstance of the case, the petitioners are directed to be enlarged on bail on furnishing bail

Patna High Court CR. MISC. No.78960 of 2019(2) dt.11-12-2019 2/2 bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Special Judge, Excise, 9th Additional Sessions Judge-cum-Special Judge, Excise, East Champaran, Motihari in connection with Kotwa P.S. Case No. 313 of 2019, subject to the condition that one of the bailors of the petitioners shall be a close relative. The petitioners will not induce any witness or tamper with the evidence. The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court. If the petitioners are found involved in future in the same offence, the prosecution will have liberty to file an application for cancellation of their bail bonds. (Shivaji Pandey, J) Mahesh/- U T
