The petitioner is languishing in custody since 01.05.2018 in a case registered for the offence punishable under Sections 25(1-B)a, 26, 35 of the Arms Act. The prosecution case as per the self-statement of Kundan Kumar, S.I.-cum-SHO, Dawadh P.S. recorded on 29.04.2018 at 7.30 P.M. is to the effect that the informant after having received a secret information that a wanted accused, the petitioner Ripu Ranjan Kumar of Dawadh P.S. Case No. 20 of 2018 along with one other accused person, is preparing to commit dacoity near a poultry farm, whereupon, the informant along with the police party reached at the poultry farm, then on seeing the police party, two persons tried to escape from the
Patna High Court Cr.Misc. No.75316 of 2018(3) dt.01-02-2019 2/3 scene, but were apprehended. Who disclosed their names as Ripu Ranjan Kumar, the petitioner and co-accused, Rajnish Kumar @ Babu Dhan. On frisking, from the petitioner one loaded country made pistol, whereas, from co-accused, Rajnish Kumar, one loaded country made pistol and a mobile phone were recovered.
It is submitted by learned counsel for the petitioner that the petitioner has maliciously been roped in the present case and the investigation has already been concluded. It is further submitted that though the petitioner is accused in eight other cases, apart from the present case, but in most of the cases, he has been roped in, during the investigation. Learned APP for the State after going through the case diary submits that a loaded country made pistol has been recovered from the possession of the petitioner and the petitioner has serious criminal antecedent.
Considering the nature of recovery and investigation being concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Bikramganj, in connection with Dawath P.S. Case No. 45 of 2018.
