====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL JUDGMENT Date : 23-09-2024 Heard learned counsel for the petitioners and I intend to dispose of the present petition at the stage of admission itself.

02. The petitioners have approached this Court with limited prayer for early disposal of Title Suit No. 27 of 2009 which has been pending before the learned Sub Judge-I, Lakhisarai, within a stipulated time period.

03. Learned counsel for the petitioners submits that for the last 15 years, Title Suit No. 27 of 2009 has been pending.

3/4 The other-side have been trying to make some construction over the suit land but the learned trial court is not taking steps either to maintain status quo or to preserve the suit property nor the title suit is being disposed of. Learned counsel further submits that at present the court of learned Sub-Judge-I, Lakhisarai is lying vacant and most of the time, the presiding officers get promoted or transferred, so that the matter was never taken up for disposal with right earnest.

04. Since the petitioners have approached this Court with limited prayer for early disposal of Title Suit No. 27 of 2009 pending before the learned trial court, I do not think there is any need to issue notice to the respondents as early disposal of civil cases are in larger public interest.

In the light of aforesaid facts and circumstances, the learned District Judge, Lakhisarai is directed to ensure that Title Suit No. 27 of 2009 is transferred to some running court with direction to dispose of the same within a year from the date of receipt/production of a copy of this order. The learned trial court concerned would also take steps for disposal of the interim application(s), if any, within a month of the receipt of the case record.

06. With the aforesaid direction, the present petition
