The petitioners seek bail in a case registered under Sections 302/34 of the Indian Penal Code.
The prosecution case in brief is that son of the informant was found lying dead on the road with oozing of blood. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 01-09-2018. Charge sheet has already been submitted. As per FIR, named persons along with two unknown persons are said to have
Patna High Court CR. MISC. No.4914 of 2019(3) dt.22-04-2019 2/2 caused injury upon the deceased. General and omnibus allegation has been made against the petitioners. No specific injury is attributed to the petitioners. As per postmortem report, only one external injury was found on the head of the deceased. On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Nawada in connection with Sirdala (Meskaur) P.S. Case No. 137 of 2018.
