ANJANA MISHRA ORAL ORDER 05-12-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Kurtha P.S. Case No.138 of 2019 registered for the offence punishable under Sections 147, 149, 323, 332, 354, 427, 504 and 506 of the Indian Penal Code and Section 3⁄4 of the Prevention of Damage to Public Property Act.

Learned counsel for the petitioners submits that the entire allegation by the police is based on mischievous report of certain co-villagers and these petitioners have nothing to do with the damage of property; leave alone the jeep which had

Learned counsel for the petitioners further submits that at best, the petitioners can be treated to be the members of the crowd and no one has seen them throwing bricks on the vehicle. It is further submitted that these petitioners have no criminal antecedents.

Considering the aforementioned facts and circumstances, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Arwal, in connection with Kurtha P.S. Case No.138 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
