2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise (Amendment) Act 2018 .

3 . It is alleged that 18.55 liters of foreign liquor was recovered from a bag which is allegedly thrown by this petitioner. It is further alleged that this petitioner fled away after seeing police party .

4. It is submitted that the petitioner is innocent and has falsely been implicated in this case only on the basis of suspicion . No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner has got one

5 . Learned counsel for the State opposes the bail petition .

Considering the facts of the case, in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court II Bhojpur Ara in connection with Sahpur Police Station Case No. 369 of 2024 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
