The petitioner seeks regular bail in connection with Kotwali (Tilkamanjhi) P.S. Case No. 908 of 2017 registered for the offence punishable under Section 379 of the Indian Penal Code.

The allegation is regarding the motorcycle of the informant having been stolen by unknown accused persons. The learned counsel for the petitioner has submitted that neither any stolen motorcycle has been recovered from the house of the petitioner nor the petitioner has got anything to do with the alleged occurrence. However, he has been falsely made accused in the present case only after disclosure of his name by co-accused Pintu Kumar Singh from whose house the stolen

Patna High Court Cr.Misc. No.76558 of 2018(2) dt.11-01-2019 2/2 motorcycle was recovered. The petitioner is stated to be languishing in custody since 04.08.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Tilkamanjhi) P.S. Case No. 908 of 2017.
