The petitioners being parents of the husband of the complainant are apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Section 498 of the IPC and Sections 3 and 4 of Dowry Prohibition Act. The prosecution case as per the complaint is that the complainant was married with co-accused Santosh Kumar Sah but subsequent to the marriage, there was further dowry demand of Rupees One Lac and a motorcycle and due to non-fulfillment of the same, torture was inflicted upon the complainant.

No.84014 of 2019(2) dt.18-12-2019 2/2 It is submitted by learned counsel for the petitioners that the petitioners are residing separate from the husband of the complainant and they never tortured her. Statement has been made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent.

Learned APP submits that the petitioners are named in the complaint with specific accusation.

Considering the thrust of accusation against the husband of the complainant, let the petitioners above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Araria in connection with Complaint Case No.122C of 2019 subject to the conditions laid down in Section 438(2) of the Cr.P.C.
