Petitioner, who is in custody seeks bail in a case registered under Sections 20, 22 and 23 of the NDPS Act. Allegation is recovery of 2 Kg of Charas from the possession of petitioner.

It has been submitted on behalf of petitioner that petitioner has been falsely implicated in this case and nothing was recovered from his conscious possession and the mandatory provisions of NDPS Act was not followed at the time of search and seizure.

Since there is recovery of 2 Kg of Charas which is more than the commercial quantity, I am not inclined to grant
