JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-01-2020 The petitioner seeks regular bail in connection with Special Case No. 9396/2019 arising out of Salimpur P.S. Case No. 210 of 2019, registered for offences punishable under Sections 30(a), 32(1)(2)(3), 41(1) of Bihar Prohibition and Excise Act, 2016.

Prosecution case is that police recovered foreign liquor from one boat and an pick up van and petitioner was arrested on spot.

It has been submitted on behalf of the petitioner is that he has no criminal antecedent and has falsely been implicated in this case and neither boat nor motorcycle or vehicle belongs to the petitioner and he has been in custody for two and half months.

Heard learned A.P.P. also.

Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Special Case No. 9396/2019 arising out of Salimpur P.S. Case No. 210 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
