JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-09-2020 Heard learned counsel for the petitioner, learned A.P.P. for the State and also Mr. Amit Anand, learned counsel for the opposite party no.2 through Video Conferencing. The petitioner apprehends his arrest in connection with Complaint Case No. 666 of 2018, registered under Sections 498(a), 323 and 341 of the Indian Penal Code. Learned counsel for the petitioner submits that the dispute in between the petitioner and the complainant-opposite party no. 2, who are husband and wife, has been settled and in that regard, compromise petition has already been filed in the trial court.

No.81800 of 2019(5) dt.10-09-2020 2/2 On the other hand, Mr. Amit Anand, learned counsel for the complainant-opposite party no. 2 submits that since the submission of the learned counsel for the petitioner is that the dispute in between the petitioner and the opposite party no. 2, who are husband and wife, has been settled through compromise, as such, he has no objection in allowing the prearrest bail of the petitioner. In view of the submission of the learned counsel for the petitioner and the complainant-opposite party no.2, let the above named petitioner be released on bail, in the event of his surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Complaint Case No. 666 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
