2. In the present case, the petitioner seeks bail in connection with Sasaram (M) P.S. Case No. 98 of 2024 dated 02.03.2024, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 325, 307, 379, 504 and 506 of the Indian Penal Code.

3. As per the prosecution case, the allegation against the petitioner is of assaulting the husband and son of the informant and causing fracture of their hands.

4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and he has falsely been implicated in the present case. There is land dispute between the parties and it was the informant's side which was trying to dismantle the boring of the petitioner by using a JCB.

No.85520 of 2025(2) dt.10-12-2025 2/3 Learned counsel further submits that the only specific allegation against the petitioner is of hitting the husband of the informant and her son with rod causing fracture of their hands. However, no such injury has been mentioned in the rejection order, though other injuries are mentioned for which the allegation is general and omnibus. The petitioner is own brother of the husband of the informant and co-accused Sita Devi has earlier lodged Sasaram (M) P.S. Case No. 97 of 2024 for the same occurrence prior to institution of this FIR. Learned counsel next submits that petitioner is having antecedent of 3 cases and chargesheet has been submitted. Learned counsel lastly submits that petitioner is in custody since 19.09.2025.

5. Learned A.P.P. appearing on behalf of the State opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the case and counter case between the parties and the background of land dispute and also considering the period of custody of the petitioner and submission of chargesheet, the petitioner, abovenamed, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial Court.

(iii) In case of non-appearance of the petitioner on single date or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the Court concerned.
