JUSTICE BIRENDRA KUMAR ORAL ORDER 19-04-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is languishing in custody for the offences punishable under Sections 8/20C of the N.D.P.S. Act in connection with Special Case No.10 of 2017. 3284 kilograms and odd of Ganja was recovered from the truck of which the petitioner was driver and owner. The petitioner was apprehended at the spot. The petitioner is in custody since 15.01.2017. The petitioner has stated on oath that he has got no criminal antecedent.
Patna High Court CR. MISC. No.5423 of 2019(3) dt.19-04-2019 2/2 Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail is refused. The trial Court is directed to expedite the trial.
