2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 302 and 201/34 of the Indian Penal Code

3. The case of the prosecution is that the petitioner was married to Vibha Devi (daughter of the informant). It is further alleged that due to some dispute of cash the in-laws have administered poison to Vibha due to which she died.

4. Learned counsel for the petitioner has submitted that in this case the occurrence is of 15.11.2023 and the FIR has been lodged on 19.11.2023. There is delay of four days and delay is not explained. It has also been submitted that the body was

Learned counsel has also submitted that in this case the compromise petition has been filed before the trial court wherein it has been stated by the parties that as the informant came to know that the deeased was not murdered rather she died suddenly due to some illness. After that good sense prevailed between the parties and they are ready to compromise. The petitioner is a man of clean antecedent and he is in jail since 12.04.2023.

5. Learned counsel for the State has submitted that this case is not compoundable.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kawakol P.S. Case No. 123 of 2013 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned court of Additional District Judge- VIII, Nawada.
