The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 341, 323, 354, 379, 504, 34 of the Indian Penal Code.

Prosecution case as lodged by the informant is that when he gone to his land for bind in the cattle suddenly petitioners started abusing and came out the place of occurrence and assaulted him and his family members by lathi and danda. It

Patna High Court CR. MISC. No.78222 of 2019(3) dt.06-03-2020 2/2 is also alleged that petitioners snatched golden chain from the neck of the informant's daughter.

Learned counsel for the petitioners submits that they are innocent and have been falsely implicated in the present case due to land dispute. He further submits that there is case and counter case between the parties.

In the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateIII, Madhubani in connection with Babubarhi P.S. Case No. 179 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
