2. Petitioner seeks regular bail in a case registered for the offence punishable under sections 103(1), 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution case, all the FIR named accused persons including this petitioner, on account of land dispute, killed mother of the informant by slitting her neck.
4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to old animosity and land dispute. Informant is not eye witness of the occurrence. Only suspicion has been raised against the petitioner. During course of investigation, no tangible material has come to show involvement of petitioner in the alleged incident. Charge sheet
Patna High Court CR. MISC. No.87778 of 2024(3) dt.05-03-2025 2/2 has already been filed. Petitioner is in custody since 10.8.2024.
5. Learned counsel for the State and the informant oppose the prayer for bail.
6. Considering the aforesaid facts of the case, prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in Bounsi Police Station Case No. 251 of 2024.
