1. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Bounsi Police Station Case No. 144 of 2024, disclosing offences under Sections 363, 366, 34 of the Indian Penal Code.

3. As per the statement made in the complaint, the complainant-cum-informant's daughter was married to Lalu Yadav about 11 years ago and she had two children. The son-inlaw of the complainant was unemployed and suddenly, the dispute arose between the husband and wife. On 19.04.2024, in

Patna High Court CR. MISC. No.89711 of 2024(2) dt.27-01-2025 2/3 the morning, the daughter of the complainant went to the market with her husband to buy cloths, in the meantime, petitioners along with co-accused Santosh Kumar kidnapped the daughter of the complainant-cum-informant on gun point.

4. Learned Counsel for the petitioners submits that petitioner nos. 1 and 2 are parents of co-accused Santosh Kumar and petitioner no. 3 is co-villager. The victim has been recovered and her statement under Section 164 Cr.P.C. has been recorded in which she has not stated anything against the petitioners except accused Santosh Kumar against whom, she has stated that he kidnapped her and tortured her. The son of petitioner nos. 1 and 2 is in custody in relation to the present case.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the nature of allegation and the statement of victim girl recorded under Section 164 Cr.P.C. as mentioned in the impugned order, I am inclined to grant the petitioners privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs.

No.89711 of 2024(2) dt.27-01-2025 3/3 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Bounsi Police Station Case No. 144 of 2024, subject to the condition laid down under Section 438

(2) of the Code of Criminal Procedure.
