JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-01-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Bidupur P.S. Case No. 105 of 2018, G.R. No. 1799 of 2018 for the offenses under Sections 8/20(b)(ii) of the NDPS Act. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The petitioner is in custody since 26.4.2018 in a case where 30 Kgs of Ganja was recovered from the house in a trunk. He submits that when the police entered the premises the petitioner did not flee away as he has no knowledge about the fact that Ganja was kept in the truck.

Manifold submissions have been made about the seizure and sampling of the Ganja but without going into the

No.76194 of 2018(3) dt.29-01-2019 2/2 aforesaid, as the petitioner has no criminal antecedent and he has remained in custody since 26.4.2018, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 105 of 2018, G.R. No. 1799 of 2018.
