Mr.Bal Mukund Prasad Sinha ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2019 Petitioner apprehends his arrest in connection with Complaint Case No. 151C of 2017 lodged under Sections 323 and 498A of the Indian Penal Code.
Allegation against the petitioner, who happens to be husband of the victim lady, is of subjecting the complainant to cruelty and torture with respect to demand of dowry. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he is ready to keep his wife with him with all dignities.
Heard learned APP also.
In view of submission, this application is disposed of with direction to the petitioner to surrender within a period of
Patna High Court Cr.Misc. No.78790 of 2018(2) dt.16-01-2019 2/2 six weeks from the receipt of this order and on surrender learned court below shall release him on provisional bail to its own satisfaction for a period of two months and in the meantime the court below will issue notice to the complainant and thereafter if petitioner is ready to keep his wife with him and if there is no fault on the part of the petitioner, the court below will confirm his bail bond, otherwise the court below shall pass any other order/orders as it may deem fit and proper.
With the above observation, this application is disposed of.
