The petitioner is apprehending his arrest in connection with Complaint Case No.522C/2017 registered for offences punishable under Sections 307, 354(B), 376/511, 498(A), 406, 504 of the Indian Penal Code.
Allegation against the petitioner is of subjecting his wife to cruelty and harassment with respect to demand. It further appears that both the parties have appeared in this case and case was referred to the Mediation Committee also but that reference failed. It further appears from the argument of both the parties that both the parties are not ready to reconcile the matter. In such view of the matter, submission of the learned counsel for the O.P.no.2 is that some amount may be fixed for her

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction to the petitioner to surrender before the learned court below within a period of eight weeks from the date of order and he will be released on bail in connection with Complaint Case No.522C/2017 on condition that he will pay Rs.3,000/- per month to the O.P.no.2 by the first week of each month till O.P.no.2 file any proper application for maintenance before the learned Family Court, Khagaria and any interim/final order has been passed. It is needless to say that the petitioner shall co-operate in disposal of the maintenance case. O.P.no.2 shall provide Bank Account to the learned court below for that propose.
With the aforesaid observation, this application is disposed of.
